servxpress 55+ Home Maintenance Service

Welcome to ServXpress Restorations! By using our monthly home maintenance service, you
agree to the following terms and conditions:

1.1. The monthly home maintenance service provided by ServXpress Construction + Renovation (“the Company”) aims to maintain and improve the condition of your home on an ongoing basis.

1.2. The service includes routine inspections, preventive maintenance, repairs, and other related services as determined necessary by the Company.

Service Fees

2.1. The monthly home maintenance service is subject to a trade service fee, which covers the cost of labor and administration.

2.2. The trade service fee will be invoiced monthly and is due within 3 days from the invoice date.

2.3. The Company reserves the right to adjust the trade service fee at its discretion. Any changes to the fee will be communicated to the client in writing with reasonable notice.

2.4. In addition to the trade service fee, the client acknowledges that there may be additional costs that arise during the course of the home maintenance service. Such costs may include, but are not limited to:

  1. a) Materials and supplies required for repairs or replacements beyond routine maintenance.
  2. b) Fees for subcontractors or third-party specialists, if necessary.
  3. c) Permits or licenses required for specific maintenance or renovation tasks.
  4. d) Any applicable taxes, duties, or levies imposed by governing authorities.

2.5. The Company shall provide a detailed breakdown of any additional costs incurred and seek approval from the client before proceeding with the associated work.

2.6. The client agrees to pay any approved additional costs in addition to the trade service fee, as outlined in section 2.2.

Payment Terms

3.1. Payment for the trade service fee can be made via accepted methods specified by the Company, such as cash, credit card, or bank transfer.

3.2. The client agrees to provide accurate and up-to-date payment information to the Company.

3.3. In the event of late payment, the client may be subject to additional charges, including but not limited to late payment fees or interest charges.

Service Scheduling and Access

4.1. The Company will schedule the monthly home maintenance service at mutually agreed upon dates and times with the client.

4.2. The client agrees to provide access to the premises during the scheduled service visits. In case of any restrictions or changes in access, the client must notify the Company in advance.

4.3. If the client fails to provide access to the premises for three consecutive scheduled visits without prior notification, the Company reserves the right to terminate the home maintenance service without refund.

Termination

5.1. The client may terminate the monthly home maintenance service by providing written notice to the Company.

5.2. The Company may terminate the service for any reason by providing written notice to the client with reasonable notice.

5.3. In the event of termination, the client remains responsible for any outstanding trade service fees up to the effective termination date.

Limitation of Liability

6.1. The Company will make reasonable efforts to perform the monthly home maintenance service with care and professionalism.

6.2. However, the Company shall not be liable for any damages, losses, or injuries arising from the service, unless caused by willful misconduct or gross negligence on the part of the Company.

Governing Law and Jurisdiction

7.1. These terms and conditions shall be governed by and construed in accordance with the laws of Texas.

7.2. Any disputes arising from the monthly home maintenance service or these terms and conditions shall be subject to the exclusive jurisdiction of the courts in Texas.
